is a membership site owned by The Abundance Group, LLC and Steve Yakim. Throughout this document, ""TheNewYearsGiveaway.com"
is used to refer to this partnership as well as to the individual partners and their principals.

is a co-registration site just like any other giveaway. By
filling out the membership form, you agree to accept emails from the owner of every FREE gift you click on to download. If you decide to stop receiving these emails, you must click the unsubscribe link at the bottom of each publisher's email.

is a one-time, privately held event and you may only sign up to participate if you have been invited by Gina Gaudio-Graves & Steve Yakim or by an affiliate of this website.

reserves the right at its sole discretion to improve, modify or remove any information or content appearing on the website.

may discontinue or revise any or all aspects of the website at its sole discretion and without prior notice.
4) LIMIT OF LIABILITY: IN NO EVENT SHALL

6) This one-time event is void where prohibited by law.
7) Right to refuse service:

reserves the right at its sole discretion to refuse service at any time, or to remove any user or contest provider from the website at any time.
8) Affiliates may invite other individuals to become a part of this event only by the use of lawful purposes. If an affiliate is caught sending Unsolicited Commercial Email (UCE or SPAM),

reserves the right to remove that affiliate from the database and to deny any further access to him or her.
9) Affiliates who do not meet the referral requirements as found on the "Joint Venture Partner Invitation" are subject to having their gifts removed without notice. This is done solely for the purpose of keeping the promotion fair to all those who are working hard to promote

10) Reprint Rights. All gifts donated to the
TheNewYearsGiveaway.com
are required, at a minimum, to have reprint rights (aka Resale
Rights). The reason for this is that
TheNewYearsGiveaway.com
will be reprinting the gifts on the CD-ROM's purchased by members with
personal use rights, as well as on the CD-ROM's purchased by member's
with Resale Rights. JV Partners can also elect to offer either
Master Resale Rights or Private Label Rights to their gift as well.
By including your gift in the
TheNewYearsGiveaway.com,
you hereby warrant that you are the legal owner of the gift and that
your license allows you to transfer the resale rights or reprint
rights to the gift to others. By including your gift in the
TheNewYearsGiveaway.com,
you agree to indemnify and hold harmless,
TheNewYearsGiveaway.com
and it's owners, Gina Gaudio-Graves and The Abundance Group, LLC, and
Steve Yakim, from any claims, lawsuits, or other actions for copyright
infringement or violation of a license prohibiting the transfer of
resale rights or reprint rights. Furthermore, you agree that in
the event your inclusion of your gift results in any type of action
whatsoever against the
TheNewYearsGiveaway.com
or it's owners, you shall also be responsible for attorneys fees and
costs of defending such matter.
Copyright Infringement is a very serious offense that carries
with it a minimum penalty of $150,000 plus attorneys fees and costs!
DO NOT even consider including a gift unless you are sure
that you have the right to do so, in writing, from the product owner!
In the event that
TheNewYearsGiveaway.com
or it's owners become aware of, or have reason to believe, that you
may not have transferable resale rights to the gift you included in
the The New Years Giveaway, we will immediately suspend your
gift and we reserve the right to immediately remove it completely.
10) Refunds. Because of the
nature
of the products offered through
TheNewYearsGiveaway.com, no
refunds will be issued. This "No Refund Policy" applies to the purchase of the
TheNewYearsGiveaway.com
CD-ROM with personal use rights, to the Resale Rights on the
TheNewYearsGiveaway.com CD-ROM, to the Gold Membership that allows you to download all gifts without opting in to any gift-giver's subscriber's list, and to the JV Partner upgrade to Platinum Level, allowing the partner to advertise an additional gift in the Mystery Gift section of the promotion.
